Consumers Energy is using eminent domain to acquire new pipeline easements to replace an existing pipe.

Consumers Energy owns an existing pipeline that travels through Washtenaw County. It received a certificate from the Michigan Public Service Commission to replace the pipeline with a new route. In some instances, the new route runs roughly parallel to the existing pipeline. In other instances, it is deviating from the existing pipeline and imposing an easement upon previously unencumbered properties.

Pipeline easements can impact the value of properties for a number of reasons. They restrict the area in which buildings can be constructed, require removal of vegetation, prevent screening from neighboring properties, convey access to the utility company, and create safety issues. Unfortunately, the good faith offers that I have reviewed on behalf of multiple clients fail to properly address any of these issues.
